Legal Terms and Conditions


These general terms and conditions bind Torres Distribuição, S.A. (hereinafter referred to as "Watchers"), corporate entity no. 502 964 332, headquartered at Avenida Almirante Reis, 39, 1169-039 Lisbon, and the individuals and entities (hereinafter referred to as "User") who wish to purchase products and services on the website Watchers.pt.

These conditions may be changed; it is your responsibility to read them periodically, as the conditions in effect at the time of use of the website will be applicable.

Please read these general terms and conditions carefully before accessing or using the services.

By creating an account to subscribe to access the website Watchers.pt, the user agrees to the general terms and conditions of the service and the privacy and cookie policy of Watchers.

I. Definition of the Service

  1. Watchers is the legitimate owner of the website Watchers.pt and holds the marketing rights for the products and services advertised therein, including the brands Junghans, Franck Muller, Graham, Cvstos, Oris, Raymond Weil, Jaeger-LeCoultre, Messika, and Versace, distributed and represented by Watchers.

  2. The aforementioned products and services include, among others: a) Watches; b) Jewelry; c) Accessories.

II. Access

  1. The user can freely access the website watchers.pt.

  2. To make a purchase, the user must select the products they wish to acquire and add them to the shopping cart, confirming the selection.

  3. Upon checkout, the user must provide their personal and shipping information for the product to be delivered.

  4. Access to the website can also be made through Facebook or Instagram, with such access being the responsibility of the holders of those applications.

III. Links from Other Websites and Communication Services

  1. Any links from third-party websites are the sole responsibility of the respective website and its owners, not Watchers.

  2. Watchers is not obligated to monitor communication services, although it does so regularly.

IV. Sales Conditions

  1. The purchase of products and services is subject to the specific sales conditions of each product, which are stated alongside them when advertised on the website.

  2. The method and conditions of sale can be consulted in the "Sales Conditions" section.

V. Conditions of Use

  1. Watchers reserves the right to suspend access to any User who is proven to misuse or harm the website, as well as the purchasing process.

  2. Watchers reserves the right to change the access and use conditions of the website at any time, provided that it notifies its customers in advance by displaying a notice on the website or sending a communication of the change via email.

  3. Watchers reserves the right to add or remove products and services from those initially advertised.

VI. Technical and Security Conditions

  1. The User agrees to observe all applicable legal provisions, namely, not to engage in or promote illegal or offensive acts against good customs, such as the indiscriminate sending of unsolicited communications (spamming) in violation of applicable legislation on personal data processing and advertising communications via automatic calling devices, and must also observe the rules of use of the Service, under penalty of Watchers suspending or deactivating access to the website.

  2. Although the website has secure areas where information is transmitted encrypted, there are other websites that operate on an open network and are not protected against potential breaches. Watchers cannot be held responsible for the communication of passwords, confidential codes, and any sensitive information that may be intercepted.

  3. The User expressly acknowledges and accepts that the IP Network constitutes a public electronic communications network susceptible to use by multiple users and, as such, is subject to computer overloads, so Watchers does not guarantee the uninterrupted provision of the sales service, loss of information, or delays.

  4. Watchers also does not guarantee the provision of the Service in situations of unpredictable overload of the systems on which it relies or force majeure (extraordinary or unpredictable situations beyond Watchers' control).

  5. In the event of interruption of access to the website Watchers.pt due to unpredictable overload of the systems on which it relies, Watchers commits to regularize its operation as soon as possible.

  6. Watchers reserves the right to unilaterally change the layout of the website, as well as its technical configurations, always with the intent of introducing improvements or complying with legal provisions, even if such changes result in temporary interruptions of access.

  7. Watchers is free to decide to deactivate the website, but must communicate such deactivation either publicly on the same platform or by notifying the registered User via email of its intention at least sixty business days in advance of the deactivation.

VII. Intellectual Property

  1. All texts, illustrations, photographs, interface, layout, software, brands, logos, and other elements of a creative or identifying nature are the intellectual property of Watchers or have been duly licensed to Watchers for this purpose, being protected by the Copyright and Related Rights Code and the Industrial Property Code, as well as other applicable legislation, and by international treaties. Therefore, the user must use them just like any other material protected by copyright (book, movie, record, etc.), and copying, reproduction, distribution, modification, publication, or any form of exploitation, even if free or private, of any content under this contract is prohibited.

  2. Any violation of the previous number will be sanctioned by Watchers with the suspension of the service and cancellation of the User's account, and will also be subject to legal action to safeguard the rights of Watchers and its creators and collaborators, as well as compensation for damages suffered.

VIII. Electronic Communications

  1. Without prejudice to other forms of communication provided for in these General Conditions, notifications made to the User related to the use of Watchers.pt, including any changes to these General Conditions or Sales Conditions or Privacy Policy, may be made to the User's email address, by SMS, or by phone contact.

  2. The User agrees to receive any and all communication and/or notification related to the use of the website Watchers.pt at the address, contact phone number, and/or email address indicated in the registration process. At any time, they can request not to receive these communications and/or notifications via email at geral@Watchers.pt.

IX. Assignment of Contractual Position

  1. The temporary assignment or definitive transfer to third parties, rental, loan, or any other similar activity or practice of the email, username, and password defined by the User is prohibited. The User is fully responsible for the confidentiality of the access data they submit.

  2. The User authorizes Watchers to assign the contractual position it holds in this contractual relationship to any other entity, without the need for any prior communication or authorization.

X. Privacy Policy and Personal Data Processing

  1. The processing of User data is carried out in compliance with applicable legislation regarding the protection of personal data. The User's personal data is subject to automated processing and will be included in Watchers' database.

  3. When using the website, cookies are transferred to the hard drive of the User's computers to facilitate navigation. The use of cookies is a common practice on most websites, and the User can predefine the acceptance or rejection of this type of file in their browser or firewall.   4. Watchers guarantees that it will not sell your data to third parties and allows, under the law (of personal data protection and other applicable legislation), the right of access, alteration, rectification, opposition, deletion, and portability as explicitly stated in the Privacy Policy. The data subject may at any time report any violation to the Data Protection Officer of WATCHERS via email at geral@Watchers.pt.

XI. Complaints

The User may submit their complaints to Watchers within thirty days of becoming aware of the fact that gave rise to the complaint via email at geral@Watchers.pt.

XII. Withdrawal

  1. This contract may be freely terminated under Article 9 of Law No. 47/2014, of July 28, and for this purpose, the User must communicate their intention to terminate within a maximum period of 14 days from the date of access availability.

  2. The User must communicate their intention to freely terminate the contract through one of the following means:

a) Registered letter with acknowledgment of receipt;

b) Email sent to geral@Watchers.pt

XIII. Applicable Law, Jurisdiction, and Evidence

  1. The applicable law is Portuguese law.

  2. To resolve any conflict arising from any contract entered into under these general conditions, the court of the district of Lisbon shall be competent, with express waiver of any other.

  3. The parties agree that the computerized records, kept in Watchers' computer systems under reasonable security conditions, serve as proof of communications and records made between the parties.

The User declares that they have received, know, and accept the General Terms and Conditions of Use of the website described above, as well as the Sales Conditions, Privacy Policy, and Cookies Policy.
